Terms of use

1 Purpose and acceptance
1.1. These terms of use (the "Terms") govern access to and use of Cordaxis Universal RC Controller (the "Program"), a Windows application for controlling radio control models (aircraft, helicopters, drones, cars and boats) from a computer, keeping a flight log and an equipment inventory, and taking part in a user community.
1.2. The Program is a service of Cordaxis ("Cordaxis", "we", "us"). Any communication concerning these Terms may be sent to cordaxis.rc@gmail.com.
1.3. By registering for the Program, you ("you", the "User") accept these Terms and the Privacy Policy in full. If you do not accept them, you may not create an account or use the Program.
2 User account
2.1. Minimum age. To register, you must have reached the age at which the law of your country of residence allows you to consent on your own to the processing of your personal data by online services: fourteen (14) in Spain, under Article 7 of Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights; between thirteen (13) and sixteen (16) in the other Member States of the European Union, according to their national law; thirteen (13) in the United States; and eighteen (18) in India.
2.2. Your date of birth is requested at registration solely to verify this requirement. Only the year is retained, as described in the Privacy Policy.
2.3. An account is required to use the Program, including its setup and piloting features. Accordingly, persons who have not reached the minimum age may not use it.
2.4. The minimum age for registration is not the age of majority. Recommendations for minors when piloting are set out in clause 7.
2.5. You undertake to provide accurate information and to keep your password confidential, and you must notify us without delay of any unauthorised access to your account. We may close accounts created with false information.
2.6. Each person may hold only one account.
3 Community rules and moderation
3.1. The forum, clubs, wall and private messages are intended for discussion of radio control. The following are prohibited:
harassing, threatening or insulting others;
publishing sexual content involving minors, or attempting to contact a minor for that purpose, which will in all cases be reported to the competent authorities;
publishing unlawful content, or content that incites hatred or violence;
sending unsolicited advertising, spam or fraudulent communications;
impersonating another person or a brand;
disclosing the personal data of others without their consent;
linking to malicious software or phishing sites.
3.2. Any user may report content from within the Program. We will review reports and, depending on the seriousness of the case, may remove the content, warn the user, restrict their access to the community or close their account. We will inform the affected user of the measure taken and the reasons for it, and the user may respond by writing to cordaxis.rc@gmail.com.
3.3. The foregoing is without prejudice to the user's right to bring the matter before the courts or before an alternative dispute resolution body.
4 Content published by users
4.1. You retain ownership of the texts and images you publish. By publishing them, you grant Cordaxis a nonexclusive licence, free of charge, to store and display them within the Program, limited to what is necessary for the community to function. The licence ends when you remove the content, except for the moderation copies described in the Privacy Policy.
4.2. You may delete your posts at any time. So that other users' replies keep their context, an empty entry will remain in place of the deleted message.
5 Subscription, payments and right of withdrawal
5.1. The Program offers free features and paid features by subscription. The price, including taxes, and the features included are shown before purchase. Prices are adjusted to purchasing power in each country, and the amount payable is the one shown at checkout.
5.2. Payments are processed by Paddle, which acts as the merchant of record for the subscription.
5.3. The subscription renews automatically at the end of each period unless cancelled. You may cancel at any time, with effect from the end of the period already paid for.
5.4. If you are a consumer, you have fourteen (14) calendar days from purchase to withdraw from the contract without giving any reason. As the contract concerns the supply of digital content, the right of withdrawal is lost once performance has begun with your prior express consent and your acknowledgement that you thereby lose that right. This consent is requested at checkout; if you do not give it, you keep the full period. To exercise the right of withdrawal, it is sufficient to notify cordaxis.rc@gmail.com.
5.5. Donations. Separately, you may make single donations through PayPal, on PayPal's own page. Donations are voluntary, grant access to no feature, create no subscription and do not renew. If a donation is made for the wrong amount, we will refund it at the donor's request.
6 Conformity, updates and support period
6.1. While your subscription is in force, we will keep the Program in working order and supply the updates necessary to maintain its conformity, including security updates, in accordance with Directive (EU) 2019/770 and the national laws transposing it.
6.2. In the event of a lack of conformity, you are entitled to have it remedied and, where that is not possible, to a proportionate reduction of the price or to terminate the contract.
6.3. We will provide support and security updates for each released version for a period of five (5) years from its release, in accordance with Regulation (EU) 2024/2847 (the Cyber Resilience Act).
7 Safety warnings when piloting
7.1. The Program is an auxiliary tool and does not replace your radio control transmitter. It runs on a personal computer, which may freeze, run out of battery or lose the connection with the controller at any time. You may therefore use it for piloting only if, throughout the session:
the original transmitter is switched on, bound to the model, and in your hands or within your immediate reach;
the transmitter's trainer function is set up so that releasing the trainer switch returns control of the model to the transmitter;
you have checked on the ground, before starting, that control is regained in this way.
If the Program, the computer or the model behaves abnormally, you must immediately take back control with the transmitter. Any damage resulting from a failure to meet these obligations is attributable to you, without prejudice to clause 8.2.
7.2. The pilot alone is responsible for deciding where to operate, with which model, under what conditions and at what distance from people, animals, vehicles, buildings or power lines. The Program does not know the user's location or surroundings, cannot prevent a manoeuvre and is not a safety system.
7.3. You must comply with the rules that apply where you operate, in particular those governing model aircraft and unmanned aircraft, which in the European Union are laid down in Commission Implementing Regulation (EU) 2019/947, as well as the rules of your club, your municipality and the roads or waters on which you drive or sail. Damage resulting from a failure to comply with those rules is the responsibility of the person piloting.
7.4. Minors are advised to pilot under the supervision of an adult, given the risks posed by the propellers, motors and mass of the models. This recommendation does not alter the minimum age for registration set out in clause 2.
8 Liability
8.1. Cordaxis is liable for damage resulting from a breach of its obligations, as provided by law.
8.2. The limitations of liability in these Terms do not apply where the law does not allow liability to be limited, and in particular to:
death or personal injury;
damage caused intentionally or through gross negligence;
damage caused by defective products.
Nor do they affect the rights that consumer protection law grants you. If any provision of these Terms could be read otherwise, it shall not apply to that extent.
8.3. Except in the cases above and to the extent permitted by law, Cordaxis is not liable for indirect damage or loss of profit.
8.4. Without prejudice to the conformity obligations in clause 6, the Program is supplied as is. We do not warrant that it is fit for any particular purpose of yours, that it works with every combination of transmitter, receiver, controller or operating system, or that it is free from errors.
8.5. You shall hold Cordaxis harmless against any claim brought by a third party, including defence costs, arising from the way you piloted, from a breach of the rules applicable where you operated or from content you published, unless the damage is attributable to Cordaxis.
8.6. The online services (community, forum, clubs, messaging and rankings) depend on servers, on your connection and on external providers, and may therefore be subject to interruptions, maintenance or failures. We do not guarantee uninterrupted availability. If a prolonged interruption deprives you of the features you paid for, clauses 6 and 9 apply.
8.7. Profiles, settings, the flight log and the inventory are stored on your computer, and you are responsible for backing them up. We cannot recover data lost through hardware failure, formatting or accidental deletion. Data stored in the cloud can be exported at any time from User settings.
8.8. You may not resell the Program as your own, decompile it to circumvent the limits of the paid features, automate accounts or use it to fly in breach of the law. We may close the account of any user who does so, and that user shall be liable for any resulting damage.
8.9. Cordaxis is not liable for failures caused by circumstances beyond its reasonable control, such as outages of hosting or payment providers, network or power failures, cyberattacks, disasters or regulatory changes that require a feature to be suspended.
9 Term and termination
9.1. You may delete your account at any time from the "Privacy and your data" section of User settings.
9.2. We may close your account if you seriously breach clause 3, or repeatedly after a warning, and we will inform you of the decision and the reasons for it.
9.3. If we cease to provide the service, we will give reasonable notice and refund the unused portion of your subscription.
10 Changes to these Terms
We may amend these Terms. Amendments will be notified within the Program with reasonable notice and will require your acceptance. If you do not accept them, you may delete your account, and the unused portion of your subscription will be refunded.
11 Governing law and jurisdiction
These Terms are governed by Spanish law. If you are a consumer, this does not deprive you of the protection afforded to you by the mandatory provisions of the law of your country of residence, and you may bring proceedings before the courts of your place of residence.
